Experience

Legal Roles

Prior to joining McIntyre Szabo PC, Kyle (he/him) obtained a wide array experience in civil and administrative litigation encompassing disputes dealing with construction, Indigenous rights, insurance, health law, product liability, professional liability, professional regulation, and the resource sector.

Practice Areas

Kyle represents and advises clients in the health care sector, including healthcare institutions (regulators, multidisciplinary clinics, and professional associations) as well as regulated health practitioners and other regulated professionals. He is building a broad-based health litigation practice at McIntyre Szabo PC, including professional regulation, mental health hearings and appeals, physician privileging, human rights applications and inquests.

Courts & Tribunals

Kyle has appeared before all levels of court in Ontario, the Federal Court of Canada, the Health Professions Appeal and Review Board, the Consent and Capacity Board and the Workplace Safety and Insurance Appeals Tribunal.

Health Industry

Kyle has a gained a deep understanding of the practical concerns facing health care providers on a day-to-day basis both through his work with regulated health professionals and his relationships with friends and family working in the healthcare industry.

External Activities

Kyle is keenly interested in any opportunities to continue to improve his skills as a litigator and is an active member of The Advocates Society. Kyle sits on the Board of Directors for Geriatric Psychiatry Community Services of Ottawa. While at Dalhousie, he volunteered with the Elizabeth Fry Society and worked as a peer educator with the School’s Indigenous Blacks and Mi’kmaw Initiative, a privileged reserved for students in the top 10% of their class.

Outside the Law

Kyle is a fitness enthusiast, music fan, and a dedicated (but at times over-ambitious) amateur chef. He plays in ball hockey, curling, and softball leagues, and plays guitar and the drums. He also has a knack for getting booed off stage at karaoke bars despite his enthusiastic (but tone-deaf) performances.

Representative Cases

  • In the Matter of HH (2024, Consent and Capacity Board) - represented Ontario Health atHome on a CCB appeal relating to incapacity to make a decision relating to admission to long-term care (to be reported)

  • Inquest into the Death of Jordan Paim (2024, Coroner’s Inquest) - represented an Indigenous health organization as a party in the inquest

  • M.M. Secure Treatment Application (2024, Superior Court) - represented a Hospital in obtaining a secure treatment application for a minor

  • R.W. v. Dr. V.M. (2024, HPARB) - defended a dentist in an appeal of an ICRC decision to take no further action (decision under reserve)
